EngineerGuyApp is an AI-powered audio mixing and mastering application operated by EngineerGuyApp LLC at engineerguyapp.com. These Terms of Service ("Terms") govern your access to and use of the EngineerGuyApp platform, website, and services (collectively, the "Service"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years of age to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that all information you provide is accurate and that you have the legal capacity to enter into this agreement.
Engineer Guy is an AI-powered audio production platform that provides mixing analysis, mastering assistance, reference track comparison, AI engineering chat, and related audio tools. The Service is provided on a freemium basis, with additional features available through paid subscription plans ("Pro" and "Studio").
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@engineerguy.app of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.
"User Content" means any audio files, project data, text, or other materials you upload, submit, or transmit through the Service.

Paid plans are billed on a monthly or annual basis via Stripe, our third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
The Service uses artificial intelligence to generate mixing analysis, mastering suggestions, and engineering feedback. All AI-generated output is provided for informational and creative assistance purposes only. Engineer Guy makes no guarantees about the accuracy, quality, or fitness of AI outputs for any specific professional or commercial purpose. You are solely responsible for any decisions made based on the Service's output.
The Engineer Guy name, logo, platform design, software, and all associated intellectual property are owned by or licensed to Engineer Guy and are protected by copyright, trademark, and other applicable laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without our prior written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENGINEER GUY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Engineer Guy and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your infringement of any third-party rights.
We may suspend or terminate your account at any time, with or without cause or notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association in Delaware. You waive any right to participate in a class action lawsuit or class-wide arbitration.
EngineerGuyApp offers optional integration with TikTok through TikTok's Login Kit and Content Posting API. By connecting your TikTok account to EngineerGuyApp, you authorize us to access your TikTok profile information (display name, profile picture) and to upload and publish content to TikTok on your behalf solely when you explicitly request it within the EngineerGuyApp platform.
EngineerGuyApp will never post to your TikTok account without your direct action. You may disconnect your TikTok account at any time from your EngineerGuyApp account settings. Your use of TikTok through this integration is also subject to TikTok's Terms of Service.
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
